According to CNN, they have declared war against Hamas. So they have carefully avoided that trap.
Without judging anything else that's happening, is that legal? Can you make a formal declaration of war against an organisation like that?
In some ways it might be a good thing if at least in theory they're subject to the laws of war.
The declaration really doesn't matter, nor the use of the word war by Netanyahu. Never mind who is in the moral right, Hamas's actions are a de facto declaration of war and not just another act of terrorism/retaliation and there will be thousands killed whether it ticks the right legal boxes or not. From one BBC report: "That message was underlined by Hamas itself. “We are prepared for all options, including all-out war,” said Saleh al-Arouri, the deputy head of the Hamas political bureau."
Apart from anything it's interesting rhetoric especially given that since 9/11* various governments have, for various reasons used euphemistic language to describe either the conflicts in which they're involved, or the participants.
The Israeli government obviously has the strength of feeling behind it and the confidence to just say 'right, f*ck you, it's WAR'.
